This training will cover the impact of COVID-19 on HIPAA regulations. COVID-19 restrictions have required that some HIPAA regulations become less stringent. There have been a series of notifications from the Department of Health and Human Services explaining the changes. We will review changes and discuss their impact on your daily practice.

This training is for behavioral health clinicians, HIPPA compliance offers, and any staff interested in learning important applications of HIPAA in behavioral health. We will discuss telehealth, HIPAA restrictions, and the impact of COVID-19 on them. We will also discuss 42 CFR Part 2 which covers alcohol and substance abuse regulations. We will look at recent and proposed changes to 42 CFR Part 2 and the impact of COVID-19 on regulations.

The workshop will cover:
  • HIPAA regulations specific tobehavioral health
  • Impact of COVID-19 on HIPAA regulations
  • Telehealth, HIPAA, and COVID-19
  • 42 CFR Part2 – recent and proposed changes
  • 42 CFR Part 2 and COVID-19
Learning Objectives
  1. Participants are able to describe one or more special provisions in California law for protecting reports and records of minors in drug dependency treatment.
  2. Participants are able to describe at least one proposed change to HIPAA privacy and security rules for improving information sharing for care coordination while safeguarding PHI among clients in behavioral health treatment.
  3. Participants are able to describe eight required elements in consent forms under HIPAA and 42 CFR Part 2 for protecting the confidentiality of clients in substance abuse treatment.
  4. Participants are able to describe one or more flexibilities under HIPAA for providing telehealth during the COVID-19 public health emergency for reaching those most at risk while safeguarding confidentiality among clients in behavioral health treatment.
